Welcome to The Lead Freak ("Company," "we," "us," or "our"). By accessing or using our platform at TheLeadFreak.com (the "Service"), you agree to be bound by these Terms of Service. Please read them carefully.
By registering an account, placing a bid, or otherwise using the Service, you confirm that you are at least 18 years old, have the legal authority to enter into this agreement, and agree to comply with these Terms.
The Lead Freak operates a real-time auction marketplace where qualified inbound leads — captured via AI-powered voice intake — are made available for purchase by registered buyers. Each lead is sold exclusively to one buyer per auction. We do not guarantee: (a) the quality or eventual conversion of any lead; (b) that a lead will result in a sale, contract, or business relationship; (c) the accuracy of all lead information provided by callers.
You must provide accurate information during registration (name, email, phone number). You are responsible for maintaining the confidentiality of your account credentials and for all activity occurring under your account. You agree to notify us immediately at hello@theleadfreak.com of any unauthorized use.
You agree not to: (a) use bots, scripts, or automated systems to place bids; (b) resell lead contact information to third parties; (c) harass, intimidate, or engage in unlawful communication with leads; (d) misrepresent your identity or business to leads; (e) use the Service for any unlawful purpose.
Lead contact information is provided solely for the purpose of genuine business outreach related to the service the caller requested. You agree to maintain the privacy of lead data, not to add leads to third-party marketing lists without their consent, and to comply with all applicable laws including the TCPA, CAN-SPAM Act, and state consumer protection laws.
The Service is free to join and browse. You pay only when you win an auction. All payments are processed securely by Stripe. Prices are displayed in US Dollars (USD). The Company reserves the right to modify pricing structures with 30 days notice.
All platform content, design, code, trademarks, and AI systems are the property of The Lead Freak LLC. You may not copy, reproduce, or create derivative works from any platform component without express written consent.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT LEADS WILL RESULT IN BUSINESS. YOUR USE OF THE SERVICE IS ENTIRELY AT YOUR OWN RISK.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE LEAD FREAK LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE PRECEDING 90 DAYS.
You agree to indemnify and hold harmless The Lead Freak LLC, its officers, directors, employees, and agents from any claims, damages, liabilities, and expenses arising from your use of the Service, violation of these Terms, or violation of any third-party rights.
We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or for any reason at our sole discretion. You may close your account at any time by contacting hello@theleadfreak.com.
These Terms shall be governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved by binding arbitration under the AAA Commercial Arbitration Rules.
We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms. We will notify registered users via email of material changes.
